We have one, and only one, core principle to our litigation philosophy: every case we receive is treated as though it will be tried to its ultimate conclusion.

Cabaniss Smith Toole & Wiggins, PL, prides itself on this principle. While we recognize that reaching trial does not occur for the majority of cases, we believe the best results for our clients — whether by verdict or settlement — are achieved by demonstrating we can reach verdict no matter the situation. This is the reputation we have established.

Sometimes we are asked to assume responsibility as lead trial counsel for cases that are scheduled for trial in a relatively short period of time. While we believe our clients are better served by involving us at the outset of a case, we have experience in being able to put together a trial team to meet these challenges in various jurisdictions throughout the country. We have often been called upon to get a case “back on track".

We understand the legal challenges facing our clients: runaway jury verdicts, unprecedented damages and punitive damage awards, adverse media attention, self-interested “consumer advocates,” increasing legal fees and costs, well organized and coordinated plaintiffs’ counsel, and heightened governmental scrutiny of their business or their industry. Most importantly, we know that outside counsel must do more than represent and advocate; they must be part of the overall solution to the multiple problems facing their clients.
